1. About Us

Country Road Drone Services, LLC, an Iowa limited liability company ("we," "us," or "our"), provides agricultural drone spray services. These Terms apply to your use of this website (crds.biz) and to spray services we provide to you.

We keep our spray records using the DroneCommand™ software platform, which is made and sold by Drone Command, LLC. Drone Command, LLC is a separate company: it does not perform spray services, it is not a party to these Terms, and it is not responsible for our spray services. Your use of the DroneCommand software, if any, is governed by Drone Command, LLC's own Terms of Service and End-User License Agreement.

Earlier versions. Before October 20, 2026, the terms for our spray services were published as part of a combined Terms of Service at dronecommand.online. From that date, these Terms govern our spray services, and that document governs only the DroneCommand software. The combined Terms of Service that applied before that date remains available at www.dronecommand.online/legal/archive/2026-09-08/terms.html.

Drone Spray Services Terms

3. Drone Spray Services

Our agricultural drone spray services are provided under a separate written service agreement executed by both parties prior to service ("Service Agreement"). Terms including pricing, acreage, product application rates, scheduling, and payment are established in that agreement. In the event of any conflict between an executed Service Agreement and these Terms regarding liability, indemnification, or dispute resolution, the Service Agreement controls solely for claims directly arising from the specific spray service it covers. Where no executed Service Agreement exists for a particular spray service, these Terms apply in full, including the arbitration clause in Section 11 and the liability limitation in Section 9.

We maintain commercially reasonable liability insurance for our drone spray operations, including coverage for property damage and bodily injury claims arising from aerial pesticide application. Coverage amounts are available upon written request. Maintenance of insurance does not expand our liability beyond the limits set forth in Section 9 of these Terms.

We operate as a licensed commercial pesticide applicator. Operators performing aerial application hold the applicable state commercial pesticide applicator licenses (in Iowa, issued under Iowa Code Chapter 206) and operate under FAA regulations applicable to their operations. Depending on the nature and scope of an aerial application, applicable FAA rules may include 14 C.F.R. Part 107 (small unmanned aircraft systems) or 14 C.F.R. Part 137 (agricultural aircraft operations); complying with all applicable FAA rules is our responsibility. You are solely responsible for independently verifying license and insurance status before service commences; a certificate of insurance is available on request, but we do not provide license verification as a service. Nothing in these Terms constitutes a guarantee of any particular regulatory outcome or agricultural result.

4. Scheduling and Cancellation

Spray services are subject to weather conditions, field access, and equipment availability. We reserve the right to reschedule services at any time due to weather, wind conditions, or other factors affecting safe application. We will notify you as soon as practicable of any rescheduling. Rescheduling by us does not entitle you to a refund of any deposit paid.

If you need to cancel or reschedule, contact us at 712-420-0871 as early as possible. Cancellations made less than 24 hours before the scheduled service time may result in charges for pesticide products specifically purchased for your job and already mixed or loaded, plus documented direct mobilization costs. We will provide an itemized invoice within 5 business days of cancellation. You may dispute any charges within 14 days, and we will provide receipts substantiating all claimed costs. Cancellations with more than 24 hours' notice will not incur charges unless materials were purchased specifically for your job at your prior written request.

5. Customer Responsibilities

By engaging our spray services, you agree to:

6. Application Records

We keep pesticide application records for our spray services as required by Iowa law. Copies of the application records for your fields are available to you upon request. Where applicable law or a regulatory agency (such as the Iowa Department of Agriculture and Land Stewardship) requires submission of application records to a government authority by the landowner or customer, that submission obligation rests with you unless separately agreed in writing.

It is your responsibility to ensure that any products you request or supply comply with label requirements and applicable regulations for your specific crop and location. We do not provide legal, regulatory, or agronomic advice. Any statements made by our personnel (whether by phone, email, or text) regarding product rates, application timing, or crop compatibility are informational only and do not constitute professional agronomic or regulatory advice. You should verify all product usage with the product label and, where appropriate, a licensed agronomist or certified crop advisor.

Legal hold. If you anticipate or become involved in a legal proceeding, regulatory investigation, or dispute related to any spray service we performed, you must notify us promptly at [email protected]. Upon receiving such notice, we will place a legal hold on all records related to the involved operations and will not delete or destroy them until the dispute is fully resolved and a written release is provided, or until 5 years from the date of application, whichever date is later. We honor valid subpoenas and court orders for records without further notice. If you receive a regulatory inspection notice, records demand, or audit request from any government authority (including the Iowa Department of Agriculture and Land Stewardship or any state pesticide regulatory agency) that relates to an application we performed, such notice constitutes a triggering event for this legal hold provision regardless of whether formal litigation or dispute has commenced.

General Protections

7. Force Majeure

Neither party shall be liable for any delay or failure to perform resulting from causes beyond their reasonable control, including but not limited to acts of God, natural disasters, floods, fires, earthquakes, pandemic, war, terrorism, government action, internet or telecommunications outages, power failures, labor disputes, or third-party service failures. If a force majeure event prevents performance for more than 30 consecutive days, either party may terminate the affected service agreement with written notice.

8. Indemnification

You agree to indemnify, defend, and hold harmless Country Road Drone Services, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to the items listed below; provided, however, that this indemnification obligation does not apply to the extent that the claim arises from our own gross negligence, willful misconduct, or fraud:

9. Limitation of Liability

To the fullest extent permitted by applicable law, Country Road Drone Services, LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to these Terms, our services, or your use of this website — including but not limited to loss of profits, business interruption, loss of goodwill, or cost of substitute services — even if advised of the possibility of such damages.

For claims arising from drone spray services we provide, our liability is capped at five thousand dollars ($5,000) multiplied by the percentage of fault attributable to us as determined by the arbitrator or court. Where customer-provided information (such as field boundaries, hazard disclosures, or product rates) materially contributed to the loss, comparative fault shall be evaluated and the cap applies only to our apportioned share. The $5,000 cap does not apply where the underlying cause constitutes gross negligence, willful misconduct, or fraud by us.

The exclusions and cap above do not apply to: (a) claims arising from our gross negligence (as defined under Iowa common law, meaning conduct that constitutes a substantial and unjustifiable risk of harm representing a substantial deviation from ordinary care), willful misconduct, or fraud; (b) indemnification obligations under Section 8; or (c) any liability that cannot be limited under applicable law.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN A SERVICE AGREEMENT, OUR SERVICES AND THIS WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Agricultural outcomes — including crop yield, pest control effectiveness, and drift management — depend on many factors outside our control. We make no guarantees regarding the results of any spray application.

11. Dispute Resolution

Informal resolution first. Before initiating any formal proceeding, you agree to contact us at [email protected] with a written description of the dispute and your proposed resolution. We will attempt to resolve it informally within 30 days.

Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or our services — except as noted below — shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its then-current Commercial Arbitration Rules, or by another arbitration service mutually agreed upon in writing, rather than in court. The arbitration shall take place in Monona County, Iowa, or by remote hearing at Claimant's election. The arbitrator's decision shall be final and binding. We will pay all filing fees, arbitrator compensation, and any other costs of arbitration that would not be imposed on you in court. Each party shall otherwise pay its own attorneys' fees, except where applicable law requires otherwise or the arbitrator awards fees for frivolous claims.

Exceptions. Either party may bring claims in small claims court if the claim qualifies. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

No class actions. All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding. We likewise waive our right to bring claims against you as part of a class, collective, or representative action.

Opt-out. You may opt out of this arbitration agreement by sending written notice titled "ARBITRATION OPT-OUT" to [email protected] within 60 days of first engaging our services. If you submit a valid opt-out, arbitration does not apply to you and you may pursue claims in court. Opting out does not affect any other provision of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-law principles. For any claims not subject to arbitration under Section 11, you consent to the exclusive jurisdiction of the state courts in Monona County, Iowa, and the United States District Court for the Northern District of Iowa.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Changes do not apply to a spray service performed before the change takes effect, or to a service covered by an executed Service Agreement, which continues to govern that service.
